Court Date on Kentucky Gambling Domains

The supreme court in the US state of Kentucky has set Thursday October 22 as the date when it will hear oral arguments in Governor Steven Bashear's final appeal in a case that has pitted him against a collection of online gambling and civil liberties groups. Bashear lost a hearing at the Kentucky Court of Appeals in January, after the court said the state does not have the jurisdiction to seize online casinos' Internet domain names in order to stop them from operating in the state. Poker Players Alliance chief John Pappas said at the time that the ruling was a "tremendous victory for Internet freedom." Kentucky had shortlisted 141 domains for seizure, including PokerStars, two bingo sites and some major sports betting sites. Leading the case against Bashear in court is the Interactive Media Entertainment & Gaming Association. iMEGA lost a case last week before a US appeals court in which it claimed anti-gambling laws were too vague, unconstitutional and infringed on individuals' rights to privacy. However, the organization said the ruling showed some glimmer of hope as it indicated the issue was one of state - rather than federal jurisdiction. The Poker Players Alliance, Interactive Gaming Council, American Civil Liberties Union, Center for Democracy & Technology, Electronic Frontier Foundation, Internet Commerce Association, eBay and Network Solutions, have joined iMEGA in the suit.

Bodog Founder Calvin Ayre APCW Interviews

Billionaire Bodog founder Calvin Ayre has said in an interview that the 2006 sale of his company to the Morris Mohawk Gaming Group led him to later realize the effectiveness of Bodog as a brand name in its own right. Asked by JTodd about that 2005 Forbes interview in which the then rising star was quoted as saying "Catch me if you can," Ayre denied actually saying those exact words but said it wasn't necessarily a bad thing. "Actually I said pretty much the exact opposite. At that time my position was that we were a mainstream entertainment company who happened to be in online gaming...I think they just did that to make the article more attractive," he said, adding that it might have given him some "street cred." Originally founded in Canada in 1994 as an online gaming company, the now Antigua-based Bodog licensing group licenses the brand to the Mohawk group, Bodog Europe and to an Asian brand, the latter through an agreement with the Philippines-based Haydock Sports.

Smart Live Address Affiliate Program Shut Down

Smart Live has addressed concerns about the "suspension of its online casino affiliate program," following various media reports that the program has been shut down. Reports that the program was being shut down were published all over gambling news websites last week, leading to some confusion about the future of the program. Smart Live Affiliates commented on the OCR article shortly after, in which it clarified that the program was not being canceled, but rather was suspending the program for at least a couple of months. The company added that existing affiliates would continue to receive commissions on each player they direct to the site. "We are honoring our lifetime revenue commissions and have no intention to renege on this. It is just that whilst we are sorting out the issues affiliates will not be able to view statistics," the company said, adding that it would be ready to offer an increased rate of 40 percent commission on net revenues in the first two months after the program is relaunched. As for blaming Income Access ongoing technical issues, no further comment was made.
