Payment solutions provider PayPal is moving back into the online gambling market, and in a big way, after inking a deal with e-wallet provider Neovia. The deal means PayPal will be offered as a payment method to gamblers who use Neovia's Netbanx payments system. However, PayPal will not accept bets from users based in the United States. The deal was lauded by general manager for merchant services Cameron McLean as one that would offer "PayPal an excellent way to reach this significant (gambling) audience." Welcome Back PayPal has stayed largely away from online gambling since a 2002 decision by its parent company eBay after the United States government accused it of violating the law by transferring funds to offshore gambling websites. The world's largest e-wallet provider company had signed some smaller deals recently in the online gaming markets, including with online casino 32Red. Poker's fight for legal recognition in the United States has been given a boost after a South Carolina court again declared poker to be a game of skill, not a game of chance. Charges were dismissed on Thursday against five men who were indicted after police raided a poker game in the south-eastern US state in April 2006. Judge R. Markley Dennis said in his ruling that the men were caught playing a game of skill, not chance, and that their activity could therefore not be considered illegal gambling. In citing the "overwhelming" evidence that skill is more important than chance, the court ruled that the law was overly broad and vague, as it could be used to convict anyone playing poker in their own home. Poker advocates in South Carolina and across the United States, led by the Poker Players Alliance, praised the ruling. "Poker is not a crime in South Carolina or anywhere else, and we are grateful to the court for compiling the overwhelming evidence that proves this case and protects the rights of players," said PPA chief John Pappas. "The ruling is fully consistent with the declarations of other judges and juries across the country that Texas Hold‘em is clearly a game of predominant skill and adults who play should not be criminalized." In a similar decision made last January, a Pennsylvania judge also declared poker a game of skill, ruling that the game was not considered illegal gambling under that state's laws.

The battle to overturn anti-online gambling legislation in the United States is gathering steam, with Congressman Barney Frank's proposed legislation gaining its 59th and 60th co-sponsors. Bennie Thompson (D - Mississippi) and Adam Smith (D - Washington) both signed up last Thursday for Frank's bills, HR 2267 and HR 2266, which he introduced as part of the push to overturn the 2006 Unlawful Internet Gambling Enforcement Act (UIGEA), which effectively banned Internet gambling in the United States. Hearings on the legislation have been delayed for some time, but are still expected to come up in Congress in October. Another Delay Also last week, Frank, New York Republican Peter King and 15 other lawmakers from both sides of politics sent a letter to Federal Reserve Chairman Ben Bernanke and Treasury Secretary Timothy Geitner, urging them to delay the December 1 enforcement of the UIGEA. The legislators declared in the letter that the UIGEA has fundamental flaws, writing: "We also believe this is an unreasonable burden on regulators and the financial services industry at a time of economic crisis." The lawmakers called for a delay of one year before UIGEA goes into effect - enough time for them to overturn it through Frank's proposed legislation.
