Malta’s Prime Minister reveals plans to re-establish the Commercial Court, improving dispute resolution for the fast-growing iGaming industry.
SiGMA News reported that the reinstatement of Malta's Commercial Court would bring both efficiency and specialization to commercial disputes. And both of these are particularly important for iGaming. This is the fastest-growing industry in the island nation, after all. However, its operators often find themselves involved in complex legal disputes. The new court will provide quicker resolutions and a higher degree of specialization for gaming-related issues, he explained. Now, iGaming providers have a better chance to get their due from the legal system.
“In essence, the return of Malta’s Commercial Court is a positive move for the iGaming industry, allowing quicker resolutionof commercial disputes and instilling confidence in a rapidly growing sector,” he posed. These words were imparted to SiGMA News by Debattista, with the anticipated consequent effects on gambling companies licensed by the Malta Gaming Authority (MGA) to place bets online.
In Malta, the Civil Court currently deals with commercial disputes such as online gaming. These include the province of a small number of specialist judges who have yet to earn their full reputations or settle into particular niches. In the midst of mounting volume and disharmony among parties involved in lawsuits, timely solution become more difficult to reach. By bringing back a Commercial Court permanently and for the long term, such pressures could be relieved somewhat, leaving just those cases that really belong in the noncommercial sphere with our Civil Court. Companies now face a host of increasingly complex disputes, such complicated ones as corporate governance, mergers, contractual disagreements, or regulatory compliance. A specialized Commercial Court would help to get away from the bureaucracy typically attached to these decisions, it can afford more efficient and informed judgement based on local law - so better for everyone concerned including ourselves; which reflects needs unique in nature for that industry sector itself.
Legal professionals have widely welcomed Prime Minister Abela’s announcement. Dr. Terence Cassar, a partner at GTG Advocates, explained to SiGMA News, “This is necessary due to Malta’s recent economic growth. The re-establishment of the Commercial Court as an independent entity will be welcomed by the Maltese gaming industry.”
Cassar added that the specialization of the judiciary, which the Prime Minister mentioned as a future goal, would further enhance the legal process. For gaming companies, which operate in a highly competitive and time-sensitive market, faster legal resolutions could provide a significant advantage.
Although the Commercial Court would focus on general commercial disputes, there is potential for future judicial developments specifically targeting the gaming sector. Dr. Cassar noted the possibility of a specialized court dedicated exclusively to gaming-related disputes, given the technical nature of gaming law. However, no official plans have been announced regarding such a court.
In the meantime, the Administrative Review Tribunal will continue to handle appeals related to decisions made by the Malta Gaming Authority (MGA). For ongoing high-profile civil cases involving gaming operators, such as those connected to Austrian and German players, the re-established Commercial Court would not affect jurisdiction.
With the re-establishment of Malta’s Commercial Court, the iGaming industry is poised to benefit from faster and more efficient dispute resolution. As the sector continues to expand, this judicial reform could prove crucial in maintaining Malta’s reputation as a leading hub for gaming companies.
