New Online Deposit Limits and Gambling Regulations Take Effect in the Netherlands

As of October 1, 2024, the Netherlands has implemented new online gambling regulations, focusing on deposit limits to protect consumers from gambling-related harm. These measures, introduced by the Dutch government, apply to all licensed operators in the country and are intended to provide stricter oversight of player behavior.

Under the new rules, players will face deposit thresholds based on their net deposits within a calendar month. If a player's net deposit exceeds €700, further deposits will be blocked until the beginning of the following month. This limit is even lower for young adults aged 18 to 25, set at €300. These limits will automatically reset at the start of each calendar month.

Personalized Deposit Limits and Proof of Income

The new regulations also require players to set personal deposit limits when registering with online operators. If a player wishes to increase their limit, they must provide proof of income to the operator. Operators will then assess if the requested limit is within 30% of the player's net income.

Additionally, when players approach certain deposit limits—€350 for adults and €150 for young adults—operators are obligated to raise awareness about the available support for gambling-related harm. This includes highlighting resources like Crucks, the national self-exclusion scheme, and providing responsible gambling advice.

Responsible Gambling Messages During Gameplay

The new regulations include introducing pop-up messages during gameplay to support responsible gambling further. These messages will appear every 30 minutes to inform players how long they have played. If a player is halfway through their pre-set gaming session, an additional reminder will prompt them to assess their playtime and consider responsible gambling habits.

These measures aim to protect players from excessive gaming behavior by encouraging them to reflect on their gameplay regularly.

Industry and Legal Perspectives on New Regulations

The new rules have garnered support from the Dutch gambling trade association, VNLOK, which has praised the government's focus on player protection. "VNLOK members have already taken extra-legal measures to provide additional protection for players," said VNLOK chair Helma Lodders. The association believes these proven effective measures will keep the Dutch online gambling market safe and responsible.

However, some industry experts warn that the new regulations could increase operational costs for online operators. Alan Littler, a gambling lawyer from Kalff Katz & Franssen, told iGB News that these measures may reduce consumer spending and complicate the business landscape for operators. Littler also noted that further regulatory changes could be introduced following the review of the country's Remote Gambling Act, which is expected to conclude in October 2024.

Concerns Over Black Market Growth

Despite the support for stricter regulations, concerns remain about the potential unintended consequences of over-regulation. VNLOK and other industry bodies have expressed worries that heightened restrictions could push players toward unregulated, illegal gambling sites. "Well-intentioned measures can thus have a counterproductive effect," Lodders stated, emphasizing the need to balance regulation with maintaining a safe and legal gambling environment.

The Dutch government has also approved an increase in gambling taxes, set to rise from 30.5% to 34.2% in January 2025, with a further increase to 37.5% by January 2026. Industry experts warn that these higher taxes, combined with the new regulations, could reduce the appeal of licensed gambling operators and drive players toward the black market.

Introducing deposit limits and other responsible gambling measures in the Netherlands marks a significant step in the country's efforts to protect online players. However, careful monitoring will be required to ensure that these regulations achieve their intended goals without pushing players to unregulated platforms.
