Overview

The Spanish Directorate General for the Regulation of Gambling, also known for short as Juegoseguro is tasked by the Spanish Government with monitoring both online and land-based gambling activities in the country. According to the main gambling legislation enforced in Spain, gambling is defined as any activity involving participating in games of chance and skill. When it comes to lotteries, the Spanish State is responsible for monitoring these gambling activities.

Apart from being tasked with monitoring all the different forms of gambling activities as mentioned above, the Juegoseguro is the main gambling regulatory body in charge of carrying out the duties of regulating, authorizing, coordinating, authorizing, supervising, controlling, and, where and when necessary, sanctioning gambling operations at the state level. The Spanish Regulatory Body operates according to the main gambling legislature, Law 40 Article 66 and Law 3, which has been enforced since 2013. 

Online gambling was legalized in Spain in 2007 and the Juegoseguro is the main iGaming regulatory body. The regulatory body deals with the modalities and all forms of gambling at the state level by an enabling title that calls for specific authorization and the state-level authorization of certain gambling operations that meet the strict licensing requirements. 

The Juegoseguro is also tasked with evaluating the effects of state-level gaming regulatory proposals. The Spanish regulatory body also performs state-level gambling operations and investigates the technical systems involved. The Juegoseguro is also responsible for handling disciplinary actions against gambling operators which violate the main gambling legislation laws and regulations. The Spanish Directorate General for the Regulation of Gambling is also tasked with handling all the licensing application steps and making sure operators meet the licensing requirements.

The Juegoseguro is working with other government agencies, including the General State Administration, local governments, local and international gambling operators, and many other public and privately-owned organizations involved in the Spanish gambling market to foster the country’s economic growth. The regulatory body is also tasked with the protection of player rights via different responsible gambling practices. 

When submitting an application for a general license, several expenses for gambling administration must be paid, and the overall cost is usually over €50,000. The licensing process does not take more than six months. Essentially, the Juegoseguro has six months to complete the application approval procedure

Additionally, there is an annual charge, as detailed in the Gambling Regulation, which is determined as 0.075% of the total yearly turnover concerning profits generated the year prior. The Gambling Act offers more information about various sorts of gambling venues, including the Spanish taxation system. All gambling operators licensed by the Juegoseguro invest 25% of their gross gaming revenue in taxes. Depending on the type of gambling activity, the tax rate ranges from 10% to 25%, set on standard casino games, sports betting, and horse race betting.
