In June of 2012, Spain officially opened its doors to online gambling.  The online gambling market in Spain has seen a lot of success but the road to a successful online gambling market has been a slow and tedious process. 

In 2006, Spain passed legislation that allowed online sports betting and sports betting in retail outlets and shops.  In addition, regional governments could impose any restrictions they wanted.  Madrid was the first government to create licensing laws and regulations.  As soon as operators meet the specific requirements, the Region of Madrid issues licenses.  In addition, Madrid also extended licenses that already existed for bingo halls and land-based casinos that wanted to operate casino games, bingo and online betting. 

Eventually, all forms of online gambling were legalized in Spain and new regulations were created in order to control advertising and to prevent unlicensed casinos from operating as well as penalties for citizens and operators that did not adhere to all applicable laws.  Some of the laws and regulations regarding online gambling in Spain include:

  • Individual licenses have to be received for each type of game that the operator will be running.  Licenses that are granted to companies that will house their servers and domain name in Spain.
  • Tax rates were increased from 20% to 25%
  • Operators that are not licensed and are illegally operating in Spain can face penalties that are as much as €50 million
  • Spain has separated its poker players from the international community just like Italy

Online operators that were already in the Spanish market before online gambling were not sanctioned but they had to pay back taxes which would cost some companies millions of euros.
