Tennessee Joins 12 Other States in Making DFS Illegal

Last week, the Attorney General of Tennessee announced that daily fantasy sports (DFS) will now be considered illegal in the state. The announcement came one day after a similar announcement from Alabama, making Tennessee the 13th state so far to declare DFS illegal. The Tennessee Attorney General, Herbert Slatery, stated that gambling is defined by an activity in which the outcome is based largely on chance, and DFS is exactly that - while some degree of skill is involved (as in other gambling games), players have no control over how the athletes they have chosen will perform on any given day.  DraftKings and FanDuel, the two major DFS companies that have been taking the most heat from this fairly new issue, have been in dialogue with various states and are working to make their companies’ activity legal once again. In some states, this is just a matter of paying a licensing fee; in other states, it is a matter of receiving approval from committees and possibly more complicated procedures. Fans of DFS have been called upon to contact their state legislatures and tell them that they want to see DFS legal in their states. Other states that have also taken issue with DFS include New York, Nevada, Massachusetts, and Mississippi. While DFS is embroiled in its own struggles, online gambling in the States is not doing much better. As of now it is only regulated in three states, making it illegal in all the others.
